Committee Recommendation

Ratify the Optional Protocol to the Convention, the Committee recalls its general comment No. 6 (2018) and targets 10.2 and 10.3 of the Sustainable Development Goals and recommends that the State party adopt measures to harmonize legislation at the national, provincial, city/municipal, and sub-district levels to ensure comprehensive and uniform protection for all persons with disabilities from all forms of discrimination and to ensure the right to action and access to remedies.

In the enforcement of law in cases involving persons with disabilities, a number of situations still require serious attention from the Government, especially in the following aspects:


  1. Law enforcement officers (LEOs) still face difficulties in dealing with persons with disabilities (who are involved with the law), due to the lack of uniform training and empowerment for all elements of law enforcement, particularly regarding ethics and methods of interacting with persons with disabilities.

  2. Accessibility and reasonable accommodation in the Regional Technical Implementation Units for the Protection of Women and Children (UPTD PPA) spread across every region are not yet fully good and in accordance with the diverse range of disabilities. The lack of budget remains the main reason. Examples in Sleman and Bantul.

  3. Stigma in government agencies and society remains strong regarding the handling of persons with disabilities. Labeling as normal/abnormal, complete/incomplete, fortunate/unfortunate, still frequently occurs, or even a stigmatizing view that sees disability not as a subject of law or not as a citizen who possesses their legal rights, which results in persons with disabilities being hindered from accessing justice.
